For purposes of these Terms and Conditions and elsewhere on the website, “Paplou” means Paplou bvba, maintaining business premises at Dorpsstraat 37b, 3500 Hasselt, Belgium. With registered VAT number BE0839.781.260. Contact by e-mail info@paplou.be and by phone +3211750641.
“Buyer” means any individual or entity which has an agreement or legal relations of any kind with Paplou.
“Goods” are the subjects of all agreements and legal relations.
These Terms and Conditions will apply to any and all agreements and legal relations pursuant to which Paplou acts as online supplier of goods. Therefore, these Terms and Conditions will not be applicable to agreements made in the local retail store. Paplou has the right to change the Terms and Conditions at any time without notice.
Paplou shall comply with the statutory rules on the protection of personal data as laid down by Belgian law. Buyers will have the option of inspecting their own data and of changing or deleting such data. Buyers can do so by logging onto the website and inspecting their data, or by contacting Paplou by e-mail on shop@paplou.be.
Paplou will store the data provided by buyers in a data file. Such data will be used to execute buyers’ orders and will be kept as long as necessary for future reference. No data will be passed on to third parties in order to protect the buyer’s privacy.
Paplou will not be required to execute an order or compensate a buyer for any loss if Paplou made a mistake when presenting the item, formulating its characteristics or stating its price, and it should have been clear to the buyer that such involved a printing error; or if the buyer should not in reasonableness have relied on it under the given circumstances that Paplou would or could deliver such item with those characteristics for that price.
All prices include 21% VAT. But exclude shipping costs. Shipping costs will be stated separately when finalizing the order and may vary daily and for each order, depending on choice of delivery. Purchase agreements are concluded with natural persons not acting in the course of a profession or business only. Therefore, any VAT charged will not at any time be refunded.
Paplou offers several methods for payment: bank transfer and PayPal. Paplou will never ask for or hold on to credit card details of the buyer.
The amount of the order may be deposited in advance. On their transfer form, buyers must state the following reference: full name and order or invoice number. Once the total amount has been credited to Paplou’s account, the order will be dispatched to the buyer. If Paplou does not receive the amount within 7 weekdays, Paplou may assume that the buyer does not wish to fulfil the purchase agreement, and the goods ordered will not be supplied or reserved for the buyer.
Paplou is not responsible for payments through PayPal. Please review their Terms and Conditions on www.paypal.com.
Paplou shall make an effort to supply the goods ordered, provided that Paplou has such goods in stock, to the delivery address within 7 days of the order confirmation and the required receipt of payment. Prior to delivering an order, the buyer may be contacted to verify the correctness of the order. This may cause some delay in delivery.
The delivery periods referred to above are of an indicative nature. Should the order not be delivered within 30 days, the buyer will be entitled to cancel the order at no charge, and will be refunded for the complete amount.
Paplou shall have no liability to the buyer for any delay in the delivery of the goods to the extent that the delay is due to any event outside our reasonable control, including but not limited to war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, alien invasions, zombie attacks, governmental actions and any other similar events.
The buyer has the right to withdraw from an online purchase within 14 days after delivery of the goods. Without giving reason, and without paying any fines. The buyer will be reimbursed for the complete amount, except for the costs to return the goods. For some goods the right of withdrawal does not apply: goods made to your specifications; goods which, by their nature, cannot be returned or perishable goods like food; audio or video recordings or computer software, when the seal is broken and the packaging has been opened; goods that are used, goods with opened packages, goods that are incomplete.
The content on the website, including without limitation, the text, graphics, and photos created by and for Paplou, interactive features and the trademarks, service marks and logos contained therein, are owned by or licensed to Paplou, subject to copyright and other intellectual property rights under Belgian and foreign laws and international conventions.
Content on the website is provided AS IS for information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose whatsoever without the prior written consent of Paplou or as expressly provided herein. Paplou reserves all rights not expressly granted in and to the website and the content contained therein.
Belgian law will apply to any and all legal relations between Paplou and the buyer, regardless of the country from where the order is placed.
